These SMS Terms of Service (the “SMS Terms”) govern your participation in the text messaging program (the “SMS Program”) operated by EverVet Maryland LLC, doing business as Fairland Animal Hospital (“Fairland Animal Hospital,” “we,” “us,” or “our”). By providing your mobile telephone number to Fairland Animal Hospital or to any of its affiliated veterinary practices and consenting to receive text messages, you agree to be bound by these SMS Terms. If you do not agree, please do not opt in to the SMS Program.
1. Description of the SMS Program
The SMS Program enables Fairland Animal Hospital and its affiliated veterinary practices to communicate with existing clients via text message regarding the care of their pets and the operation of the practice. Participation in the SMS Program is offered as a convenience to clients with an active relationship with one of our practices and is not available to the general public.
Messages you may receive through the SMS Program include, but are not limited to:
- Appointment reminders, confirmations, and rescheduling notifications
- Post-visit follow-up communications and care instructions
- Prescription, medication refill, and pharmacy notifications
- Vaccination, wellness, and preventive care reminders
- Replies and responses to inquiries you initiate with your practice
- Operational notices from your clinic, including changes to hours, closures, or service availability
2. Enrollment and Consent
You are enrolled in the SMS Program when you provide your mobile telephone number to one of our affiliated practices in connection with becoming a client, scheduling an appointment, or updating your contact information, and you affirmatively consent to receive text messages from us. Enrollment is limited to individuals who maintain an active client relationship with one of our practices. Fairland Animal Hospital does not purchase, rent, lease, or otherwise acquire mobile telephone numbers from third parties for the purpose of the SMS Program.
You represent that you are the subscriber to, or the customary user of, the mobile telephone number you provide, and that you are authorized to enroll that number in the SMS Program.
3. Message Frequency
The frequency of messages you receive will vary based on your account activity, your pet’s care schedule, and your interactions with your veterinary practice. We do not guarantee a specific number of messages per month.
4. Message and Data Rates
Message and data rates may apply to each message sent or received in connection with the SMS Program. Such charges are determined by, billed by, and payable to your mobile telecommunications carrier in accordance with the terms of your wireless service plan. Fairland Animal Hospital is not responsible for any charges imposed by your carrier.
5. Opt-Out
You may withdraw your consent and unsubscribe from the SMS Program at any time by replying STOP to any text message you receive from us. Following your opt-out request, you will receive a single confirmation message acknowledging that you have been unsubscribed, and you will not receive further messages through the SMS Program. You may also contact us using the information set forth in Section 10 below to be removed from the SMS Program.
Opting out of the SMS Program does not opt you out of other forms of communication from your veterinary practice (including telephone calls and email), and does not affect the underlying client relationship between you and your practice.
6. Help and Support
For assistance with the SMS Program, reply HELP to any message you receive from us, or contact Fairland Animal Hospital using the information set forth in Section 10.
7. Carriers and Delivery
The SMS Program is available on most major United States wireless carriers. Carriers are not liable for delayed, failed, or undelivered messages. Message delivery depends on the effective transmission of messages by your carrier and is not guaranteed by Fairland Animal Hospital.
8. Privacy
Information collected in connection with the SMS Program is processed in accordance with our SMS Privacy Policy, available at https://fairlandanimalhospital.com/privacy-policy/, and our general Privacy Policy, available at https://fairlandanimalhospital.com/privacy-policy/. Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. All categories of information collected through the SMS Program are subject to the protections and limitations described in those policies.
9. Modifications
Fairland Animal Hospital reserves the right to modify these SMS Terms at any time. Any changes will be reflected in the “Last updated” date set forth above. Your continued participation in the SMS Program following the posting of revised SMS Terms constitutes your acceptance of those revisions. If you do not agree to the revised SMS Terms, you must opt out of the SMS Program as described in Section 5.

- Your opt-in, opt-out, and other preference selections relating to the SMS Program
2. Purposes of Use
We use the information described in Section 1 solely for the following purposes:
- To send the categories of messages described in our SMS Terms of Service
- To respond to inquiries and replies you initiate through the SMS Program
- To create and maintain records of your consent, opt-out elections, and other preferences as required under applicable law, including the Telephone Consumer Protection Act
- To operate, secure, monitor, troubleshoot, and improve the SMS Program
- To comply with legal, regulatory, audit, and recordkeeping obligations
3. Disclosure of Mobile Information
Mobile information, including your mobile telephone number and your consent to receive text messages, will not be shared with third parties or affiliates for marketing or promotional purposes at any time. We do not sell, rent, lease, or otherwise transfer mobile information to any third party for marketing or promotional purposes.
This restriction applies to mobile telephone numbers, opt-in records, and any other information collected in connection with your enrollment in the SMS Program. The foregoing restriction does not limit any other privacy commitments set forth in our general Privacy Policy.
4. Service Providers
In order to deliver messages on our behalf, we engage trusted service providers, including a messaging platform provider and the underlying telecommunications carrier responsible for transmitting messages over wireless networks. These service providers process mobile information solely for the purpose of delivering messages on our behalf and are contractually obligated to maintain the confidentiality and security of that information. They are not permitted to use mobile information for their own marketing or promotional purposes.
5. Data Retention
We retain mobile information for the duration of your participation in the SMS Program and for such additional period as is reasonably necessary to comply with our legal, regulatory, audit, and recordkeeping obligations, including the maintenance of proof of consent and opt-out under the Telephone Consumer Protection Act and other applicable law. When information is no longer required for these purposes, it is deleted, anonymized, or otherwise rendered inaccessible in accordance with our data retention practices.
6. Your Choices and Rights
You may withdraw your consent and unsubscribe from the SMS Program at any time by replying STOP to any message you receive from us. You may also contact us at the email address set forth in Section 9 below to request the deletion of your mobile information, subject to applicable legal retention requirements.
